TERMS OF SERVICE
Clear rules for using Explorer
These terms govern your account, private workspace, Community activity, and subscription to SellwoodFPV Explorer.
Effective August 13, 2026Operator and contact
SellwoodFPV LLC operates Explorer. Questions and legal notices may be sent to sellwoodfpv@gmail.com or mailed to SellwoodFPV LLC, 29991 Canyon Hills Rd, Ste 1709-7002, Lake Elsinore, CA 92532, United States.
Agreement and eligibility
By creating an account or using Explorer, you agree to these Terms and acknowledge the Privacy Policy. You must be at least 13. If you are under 18, you represent that a parent or legal guardian has given permission for you to use Explorer and agrees to supervise your use. You may use Explorer only if you can legally enter this agreement.
Your account
You must provide accurate information, protect your credentials, promptly notify Explorer of suspected unauthorized access, and remain responsible for activity performed through your account. Accounts are personal and may not be sold, transferred, or shared in a way that defeats security, billing, or Community limits.
Permission to use Explorer
While these Terms remain in effect, SellwoodFPV LLC grants you a limited, personal, non-exclusive, non-transferable, revocable right to use Explorer for lawful recreational FPV planning, record keeping, and Community participation. SellwoodFPV LLC and its licensors retain all rights in the application, branding, design, software, and original materials not expressly granted to you.
Flying responsibility
Explorer is a planning and record-keeping tool—not legal, regulatory, airspace, weather, navigation, property-access, or safety advice. Maps, forecasts, location details, and Community reports may be incomplete, delayed, inaccurate, or outdated. You are solely responsible for checking current rules, NOTAMs, airspace, weather, equipment, permissions, people, wildlife, and operating conditions and for flying safely and legally. Never rely on Explorer for an emergency or as the sole source for a flight decision.
Your content
You keep ownership of content you submit. You represent that you have the rights and permissions necessary to store or publish it. You grant Explorer a limited license to host, copy, process, format, and display private content solely to operate the service. When you publish a Community contribution, that license also permits Explorer to display, distribute, and promote it within Explorer until removed, subject to reasonable backup and caching periods.
Prohibited conduct
You may not use Explorer to break the law; threaten or harass others; infringe intellectual property or privacy; publish unlawful personal information; spread malware; spam; impersonate another person; scrape or resell the service; probe or bypass security; manipulate Community limits; interfere with other accounts; or encourage dangerous, unauthorized, or illegal operations. The Community Guidelines are part of these Terms.
Moderation, reports, and enforcement
Explorer may investigate reports and remove content, reduce visibility, preserve evidence, restrict features, suspend accounts, or terminate access when reasonably necessary to enforce these Terms, protect people or property, comply with law, or secure the service. Reports and requests for review may be submitted through Send feedback, emailed to sellwoodfpv@gmail.com, or mailed to SellwoodFPV LLC, 29991 Canyon Hills Rd, Ste 1709-7002, Lake Elsinore, CA 92532, United States.
Subscriptions and automatic renewal
Paid plans renew monthly until canceled. Before checkout, Explorer displays the plan, recurring price, billing frequency, renewal terms, and cancellation method. By completing checkout, you expressly authorize Stripe to charge the selected recurring amount and applicable taxes at each renewal. You may cancel online through Manage billing. Cancellation stops future renewal and normally leaves paid access active through the current billing period.
Trials do not automatically charge unless checkout clearly says otherwise and you affirmatively authorize a paid renewal. Plan changes, failed payments, cancellations, and refunds follow the Refund & Cancellation Policy. Explorer will give legally required advance notice of material price or renewal changes and retain evidence of subscription consent for the period required by California law.
Availability, changes, and third-party services
Explorer may improve, modify, suspend, or discontinue features. Reasonable notice will be provided when a material change adversely affects paid service, when practicable. Explorer depends on services such as Supabase, Vercel, Stripe, Mapbox, Open-Meteo, YouTube, and Vimeo. Their availability, content, and separate terms are outside Explorer's control.
Termination and data
You may stop using Explorer or delete your account. Explorer may terminate access for serious or repeated violations, legal requirements, security threats, or prolonged nonpayment. On termination, the license to use Explorer ends. Provisions concerning ownership, payment obligations, disclaimers, liability, disputes, and other terms that logically survive will remain effective. Export data you wish to keep before deleting an account.
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPLORER IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ACCURACY, AVAILABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE ERROR-FREE. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPLORER AND ITS OPERATOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS OR DATA; FLIGHT INCIDENTS; REGULATORY VIOLATIONS; INJURY; OR PROPERTY DAMAGE ARISING FROM USE OF OR RELIANCE ON THE SERVICE. For claims that may legally be limited, total liability will not exceed the greater of the amount you paid Explorer during the 12 months before the claim or $100. These limitations do not apply where prohibited by law.
Indemnity
To the extent permitted by law, you agree to defend and indemnify Explorer and its operator from third-party claims caused by your unlawful use, your content, your flight operations, or your material violation of these Terms. This does not require indemnification for Explorer's own unlawful conduct.
California law and disputes
These Terms are governed by California law, without regard to conflict-of-law rules, except where another law must apply. Unless applicable law requires another forum, disputes will be brought in a state or federal court with jurisdiction over the parties and the claim. These Terms do not require mandatory arbitration or impose a class-action waiver.
General terms and changes
If one provision is unenforceable, the others remain effective. A failure to enforce a provision is not a waiver. You may not assign this agreement without permission; Explorer may assign it as part of a reorganization, financing, sale, or transfer of the service. These Terms and incorporated policies are the entire agreement concerning Explorer. Material changes will be announced and, when required, presented for renewed acceptance.
